Canvassing and Election Audit Notice |
CITY OF OCOEE CANVASSING BOARD AND ELECTION AUDIT
FOR THE MARCH 9, 2010, GENERAL MUNICIPAL ELECTION
The City of Ocoee Canvassing Board will meet at the Orange County Supervisor of Elections office,
119 West Kaley Street, Orlando, Florida, at noon Wednesday, March 10, 2010, for the purpose of conducting
the logic and accuracy test on the absentee ballot tabulating equipment; canvassing the election returns;
certifying the results; and conducting an audit of the General Municipal Election.
In accordance with the Sunshine Law of Florida, this meeting is open to the public and pursuant to Section
101.68(2)(c)2, Florida State Statutes, if any elector or candidate believes that an absentee ballot is illegal
due to a defect apparent on the voter’s certificate, he or she may at any time before the ballot is removed from
the envelope, file with the Canvassing Board a protest against the canvass of that ballot, specifying the ballot
precinct, the ballot, and reason he or she believes the ballot to be illegal. A challenge based upon a defect in
the voter’s certificate may not be accepted after the ballot has been removed from the mailing envelope.
Said ballots will be made available to the public for inspection at the Orange County Supervisor of Elections
office, 119 West Kaley Street, Orlando, Florida from 11:00 a.m. until 12:00 noon prior to the Canvassing
Board convening.
If a recount is necessary, it will be conducted immediately following the canvassing of ballots.
If there are no provisional ballots, the election can be certified at that time, and the board will
select the contest and the precinct to be audited in accordance with Chapter 101.591, Florida Statutes and Rule
1S-5.026 F.A.C. If necessary, the board will reconvene on Friday, March 12, 2010, at 12:00 noon to canvass any
provisional ballots, certify the election results, and audit the election results. The finalized meeting
schedule will be posted on the City’s website and at City Hall.
Note: §286.0105, Florida Statutes, states that if a person decides to appeal any decision by a board, agency,
or commission with respect to any matter considered at a meeting or hearing, he or she will need a record of the
proceedings and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made,
which record includes the testimony and evidence upon which the appeal is to be based.
In accordance with the Americans with Disabilities Act (ADA), if any person with a disability, as defined by the
ADA, needs special accommodation to participate in this proceeding, then not later than two business days prior
to the proceeding, he or she should contact the City Clerk’s Office at 407-905-3105.

PARA LA ELECCION MUNICIPAL GENERAL DEL DIA 9 DE MARZO DEL AÑO 2010
La junta de Escrutinio Electoral de la Ciudad de Ocoee se reunirá en la oficina del Supervisor de Elecciones del
Condado Orange, 119 West Kaley Street, Orlando Florida, después de las 12:00 del mediodía, 10 de Marzo del año
2010, con el propósito de conducir una prueba lógica y precisa al equipo tabulador de las papeletas en ausencia;
escudriñar los resultados de la Elección; y certificar los resultados de la Elección Municipal General.
De acuerdo con la Ley Sunshine de la Florida, esta reunión estará abierta al público y de acuerdo con la Sección
101.68(2)(c)2, de los Estatutos de la Florida, si un elector o un candidato cree que una papeleta en ausencia es
ilegal a razón de un defecto evidente en el certificado del votante, él o ella puede en cualquier momento antes
de que la papeleta sea removida del sobre, presentar a la Junta de Escrutinio Electoral una protesta contra el
escrutinio de tal papeleta, especificando el precinto de la papeleta, la papeleta, y la razón por la cual el
elector o el candidato cree que tal papeleta es ilegal. Un reto basado en un defecto en el certificado del
votante puede ser rechazado después de que la papeleta haya sido removida del sobre. Dichas papeletas estarán
disponibles para inspección del público en la oficina del Supervisor de Elecciones del Condado Orange, 119
West Kaley Street, Orlando, Florida, desde las 11:00 A.M. hasta las 12:00 del mediodía antes de la reunión de
la Junta de Escrutinio Electoral.
Si un recuento es necesario, será conducido inmediatamente, seguido por el escrutinio de papeletas. Si no hay
papeletas provisionales, la elección se puede certificar en aquel momento y para seleccioinar la contienda
electoral y el precinto a ser auditado de acuerdo con el capítulo 101.591, de los Estatutos de la Florida y la
Regla 1S-5.026 F.A.C. Si es necesario, la junta reconvocará el Viernes 12 de Marzo del 2009 a las 12:00 del
mediodía para escudriñar cualquier papeleta provisional, certificar los resultados de elección, y auditar los
resultados de elección. El horario de reunión concluido será fijado en el Website de la ciudad y en las oficinas
de la ciudad.
NOTA: La Sección 286.0105 de los Estatutos de la Florida indica que si una persona decide apelar cualquier
decisión tomada por una junta, una agencia o una comisión con respeto a cualquier asunto considerado en una
reunión o audiencia, esta persona necesitará una acta de la sesión, y que para tal propósito, es posible que
esta persona necesite asegurarse de que se realice una acta textual (palabra por palabra) de la sesión, incluyendo
el testimonio y la evidencia sobre la cual se basará la apelación.
De acuerdo con el Acta de Americanos con Impedimentos, (ADA), si alguna persona con una incapacidad, definida en
el ADA, requiere asistencia especial para participar en este procedimiento, esta persona debe contactar a la
Secretaria de la Ciudad (City Clerk) al 407-905-3105 a más tardar dos días hábiles antes del procedimiento.
